Walker County man allegedly lived in house with dead roommate’s body for several days

A Walker County man is under arrest after he was found to be living with the remains of someone who had been dead for days.

Leandrew Smith Jr., 61, is charged with abuse of corpse.

According to Alabama law, a person commits the crime of abuse of a corpse if he or she knowingly treats a human corpse in a way that would “outrage ordinary family sensibilities.” It is a Class C felony.

On Friday, according to the Walker County Sheriff’s Office, deputies responded to a home on Fourth Avenue West in Sipsey after someone reported they found their family member dead in the home.

Smith, according to investigators, had been living in the home and had not reported the death. The identity of the person found dead has not been released, but authorities said the man had been dead for days.

Justin Hagler told AL.com it was his father who was found dead. He said he last saw him on Tuesday, June 7. When he didn’t hear from him, Hagler went looking for his father in the three days that followed.

His father, he said, was roommates with Smith but he wasn’t getting any answers from Smith about his father’s whereabouts. “He didn’t tell me my dad was in the house,’’ Hagler said.

On Friday, after Hagler had twice been to the house looking for his father, the family received a phone call to come to the home. It was then Hagler’s son found his grandfather.

Hagler said he then went to the house but was told he didn’t want to see his father in that condition.

The cause and manner of death remains under investigation. The District Attorney’s Office ordered an autopsy be performed by the Alabama Department of Forensic Sciences.

Smith remains held in the Walker County Jail on $10,000.

“I’m furious,’’ Hagler said. “I’m going to get to the bottom of this.”

“I appreciate the Walker County Sheriff’s Office,’’ he said, “and everything they’re doing.”
